Terms of Service

These Terms of Service ("Terms") govern the use of the ZapClaw platform ("ZapClaw", "we", "us", or "our").
By creating an account or using our services, you ("User" or "you") agree to these Terms in their entirety. If you do not agree, you should not use the platform.
1. Description of Service
ZapClaw is a SaaS (Software as a Service) platform that provides a lightweight WhatsApp message gateway connecting business phone numbers to the official Meta Cloud API. The service includes:
- WhatsApp Business number connection via Meta's Embedded Signup (Coexistence mode)
- Inbound message reception and forwarding to your configured webhook URL
- Outbound message sending via REST API (text, template, and media messages)
- API key management for secure programmatic access
- WhatsApp message template management and synchronization
- Dashboard for monitoring message delivery, webhook health, and API usage
ZapClaw acts as a Meta Tech Provider for the WhatsApp Cloud API, serving as a technical intermediary between the User and the Meta platform.
2. Eligibility
To use ZapClaw, you must:
- Be at least 18 years of age
- Have legal capacity to enter into contracts
- Own or have authorization to use a phone number associated with WhatsApp Business
- Provide true and complete information during registration
3. User Account
- You are responsible for maintaining the confidentiality of your access credentials (email, password, and API keys).
- You are responsible for all activities carried out under your account, including API calls made with your API keys.
- You must notify us immediately if you suspect unauthorized use of your account or API keys.
- Sharing credentials or API keys with unauthorized third parties is not permitted.
4. Acceptable Use
By using ZapClaw, you agree to:
- Comply with all applicable laws and regulations, including the LGPD and Meta/WhatsApp policies
- Not send spam or unsolicited messages
- Obtain prior consent from recipients before sending messages
- Not use the platform for illegal, offensive, defamatory content, or content that violates third-party rights
- Not attempt to access data from other platform users
- Not reverse engineer, decompile, or attempt to extract the source code of the service
- Not use the platform for purposes that violate the WhatsApp Business Messaging Policy
4.1 Prohibited Content
It is expressly prohibited to use ZapClaw to send messages related to:
- Firearms, drugs, or illegal substances
- Gambling or betting (except where legally permitted)
- Adult or sexually explicit content
- Fraud schemes, pyramid or multi-level marketing
- Discrimination based on race, gender, religion, sexual orientation, or any other personal characteristic
- Any content prohibited by Meta's WhatsApp Business Messaging Policy
5. Responsibility for Content
The User is solely responsible for the content of messages sent through the platform and via the REST API. ZapClaw does not actively monitor message content and is not responsible for:
- The content, accuracy, or legality of messages sent by the User
- Violations of intellectual property or third-party rights through message content
- Consequences arising from sending inappropriate or unauthorized messages
6. Compliance with Meta Policies
The use of the WhatsApp Business API is governed by the policies and terms of Meta Platforms, Inc. The User agrees to:
- Comply with the WhatsApp Business Messaging Policy
- Use only Meta-approved message templates to initiate conversations
- Respect the sending limits and quality standards established by Meta
- Maintain a WhatsApp Business profile with true and up-to-date information
ZapClaw reserves the right to suspend or terminate accounts that violate Meta's policies, without prior notice.
7. API Usage and Rate Limits
- API keys are scoped to your account and must not be shared with unauthorized parties.
- ZapClaw may impose rate limits on API endpoints to ensure platform stability.
- Abuse of the API (e.g., excessive requests, automated scraping) may result in temporary or permanent suspension.
- The User is responsible for the security of their API keys and webhook endpoints.
8. Webhook Forwarding
- ZapClaw forwards inbound messages and status updates to the webhook URL you configure.
- You are responsible for the availability and security of your webhook endpoint.
- ZapClaw will retry failed deliveries up to 3 times with exponential backoff.
- We are not responsible for data loss resulting from your webhook endpoint being unavailable.
9. Service Availability
ZapClaw strives to maintain the service available 24 hours a day, 7 days a week. However:
- We do not guarantee uninterrupted availability; interruptions for maintenance or technical reasons may occur.
- The availability of the WhatsApp Business API depends on Meta Platforms, Inc., over which we have no control.
- We are not responsible for unavailability caused by third parties, including Meta.
10. Limitation of Liability
To the maximum extent permitted by law:
- ZapClaw is provided "as is" and "as available".
- We are not responsible for indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the service.
- We are not responsible for actions taken by Meta regarding your WhatsApp Business number or account.
11. Intellectual Property
- The ZapClaw platform, including its software, design, brand, and content, is our exclusive property.
- Reproduction, distribution, or modification of any part of the service without prior authorization is prohibited.
- Content created by the User (messages, templates) remains the property of the User.
12. Suspension and Termination
ZapClaw reserves the right to suspend or terminate your account, without prior notice, in the following situations:
- Violation of these Terms of Service or Meta's policies
- Use of the platform for illegal or fraudulent activities
- Receiving a significant volume of complaints or blocks from recipients
- Abuse of API resources or platform infrastructure
13. Changes to Terms
We may update these Terms periodically. We will notify you of significant changes by email or through the platform. Continued use of the service after publication of changes constitutes acceptance of the new terms.
14. Applicable Law and Jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil. The jurisdiction of the Comarca of Sao Paulo, State of Sao Paulo, is elected as competent to settle any disputes arising from these Terms.
